Broadstripe Voice Privacy Notice

Broadstripe ("We") provides this notice to inform our Broadstripe Voice customers of about what information we collect, how we use it, and to whom we disclose it. Types of information. We collect and maintain personally identifiable information about our customers. The types of information that may constitute personally identifiable information includes: name; addresses including e-mail, home and billing; driver's license, telephone and social security numbers; credit card or bank account data; service subscription and system transaction information; customer correspondence or other communications; and marketing information. When customers use our voice service, we automatically collect certain usage information, including but not limited to, calling patterns, types of lines, and calls that are placed and received and their duration.

Collection and use. We collect personally identifiable information from our customers when: (1) you voluntarily provide information to us; (2) it is necessary to either provide services to you or to detect or prevent unauthorized reception of services.

We collect and use personally identifiable information for billing and customer service purposes, including to operate and provision our network, identify and resolve problems with your service; provide our enhanced services to you; resolve problems with your service; communicate with you about service issues; offer enhanced features and new product or service offerings; protect the security of our services and facilities; and to maintain our business records. We may also use your personally identifiable information in investigating and resolving issues of fraud and unauthorized use of our services.

We may collect information about you from third party sources and combine it with the information we collect from you. We may also collect and use aggregate, non-personally identifiable information about our subscribers. This information does not identify individual subscribers. Broadstripe may use the information we collect from you as well as information collected from third party sources, to market new Broadstripe services or products to you that we believe may be of interest to you. If you do not want to receive Broadstripe's promotion or marketing information calls please contact your local Broadstripe office.

Disclosures. We may disclose personally identifiable information if: (1) you provide written or electronic consent to the disclosure in advance; (2) it is necessary to provide our services to you or to carry out our business activities; or (3) it is otherwise authorized by federal law. These disclosures generally occur for, but are not limited to, account management, billing and collection services, surveys, marketing, service delivery, administration and customization, service maintenance and operations and fraud detection and prevention.

Persons that have authorized access to personally identifiable information include, but may not be limited to, Broadstripe employees; sales and service agents; other businesses that work with us to bring you our services including those vendors providing us with network facilities, billing systems and operational systems to provide service; accountants, billing, collection and legal services; outside auditors, repair and support providers; marketers of Broadstripe services; purchasing entities if we sell or transfer ownership; authorized representatives of government; and entities affiliated with us through common ownership or control (collectively "Broadstripe Representatives").

Consistent with requirements and obligations found in state and federal law, we may disclose personally identifiable information, including Private Customer Network Information ("PCNI") as defined below, to representatives of government or other authorized persons. We will disclose such information pursuant to a warrant, court order, administrative subpoena, other legal process or voluntarily if we reasonably believe that an emergency involving immediate danger of death or serious injury to any person justified disclosure of the information. We may also may also use or disclose personally identifiable information about you to protect our employees, services, property, network and customers and/or to enforce our rights under our service agreements, terms and policies, in court or elsewhere as may be necessary.

Private Customer Network Information. In the course of providing voice service, we collect and/or have access to certain additional confidential customer information which arises out of our relationship as your voice communications provider and includes, when linked to your name, address, and telephone number, the following: (1) quantity, technical configuration, type, destination, location and amount of your use of our voice service; and (2) information contained on your Broadstripe bill concerning the voice services that you receive (hereinafter, "PCNI"). PCNI does not include your name, address and telephone number. PCNI may be used by Broadstripe Representatives in provision of the Broadstripe Voice service and any other service necessary to or used in the provision of the Broadstripe Voice Service. PCNI will also be used to initiate, render, bill and collect for the Broadstripe Voice service and for other internal purposes authorized by law. Except as required by law, we do not disclose your PCNI to third parties. We do use this information internally through Broadstripe Representatives to offer you new voice communications-related services and pricing plans. If you do not want us to use your PCNI for these purposes, please send us a written notice stating your request to the address in the first paragraph in this notice.

If you would like us to offer you information on video or other non-voice communications services or our bundled offers using your PCNI, please send us a written notice stating your request to the address in the first paragraph in this notice. Consenting to allow us to use your PCNI will help us to offer you our newest offerings and services based on an analysis of the PCNI. If you give your consent it will remain in effect until you notify us that you want to revoke or change it. Any action you take to deny or restrict approval to use your PCNI will not affect our provision, now or in the future, of any service to which you subscribe.

Directory listings and caller-ID – We offer our Broadstripe Voice customers the ability to designate their listings as non-published within print or electronic directories or directory assistance services. Because of the complexity of this process and the involvement of other entities in publishing, errors may occur from time-to-time. Your name and/or telephone number may also be transmitted and displayed on a Caller ID device unless you have elected to block such information. Please note that Caller ID blocking may not prevent the display of your name and/or telephone number when you dial certain business numbers, 911, 900 numbers or toll-free numbers.

Retention. Broadstripe will retain personally identifiable information for as long as it is necessary for the purpose for which it was collected, to comply with laws governing our business, including tax and accounting laws, or to satisfy pending requests or orders for access by subscribers, the government or pursuant to court order. These retention requirements may mean that some of your personally identifiable information and, PCNI may be retained for 5 or more years.

Your right to review. You may inspect personally identifiable information we have about you by sending a written request to us at the address listed in this notice (please include your name, address and telephone number). Following your request, we may need a reasonable period of time to arrange, locate and, if necessary, prepare the information for review. In reply, we may arrange an appointment or ask that you come to our business office during regular business hours to review your personally identifiable information we have on file. Please bring a driver's license or some other form of valid government issued picture identification. If you think any of your personal information is incorrect, please notify us at the address listed in this notice (please include your name, address and telephone number) and provide proof of the inaccuracy. Where we determine, in our sole discretion, that personally identifiable information is incorrect, we will correct it.

Changes in privacy practices. We may review our privacy practices from time to time. We will inform you of any changes that we make to our privacy practices by posting changes in a revised privacy notice that will be made available to you through our service and/or postal mail. Use of our services following revisions to this privacy notices constitutes your acceptance of the revised privacy provisions.
